These Terms of Service (“Terms”) govern your use of the Modestly platform operated by Modestly ApS, registered in Denmark, CVR-nr. [TODO_LEGAL:cvr] (“Modestly”, “we”, “us”).
By creating an account, browsing, or placing an order you agree to these Terms. If you do not agree, do not use the platform.
1. Who we are
Modestly is a curated multi-brand e-commerce platform for modest fashion. We operate the platform; partner brands list and ship the products. Modestly acts as the merchant of record for payment and invoicing.
2. Eligibility
- You must be at least 18 years old to place an order.
- You must provide accurate account and shipping information.
- Account credentials are personal. You are responsible for activity under your account.
3. Orders, prices, and payment
- All prices are in Danish kroner (DKK) and include 25% Danish VAT unless otherwise stated.
- An order is binding once you have received an order confirmation email. We may refuse or cancel an order for reasons including pricing errors, stock-out, suspected fraud, or restricted destinations.
- We accept the payment methods shown at checkout. Payments are processed by Stripe Payments Europe Ltd.
4. Shipping and delivery
We ship to addresses in Denmark only. Shipping fees are shown at checkout. Estimated delivery times are provided by the partner brand and are not guaranteed. Risk of loss passes to you when the carrier delivers the package to the address you provided.
5. Right of withdrawal (14 days)
As a consumer purchasing from a Danish trader, you have a 14-day right of withdrawal under the Danish Consumer Contracts Act (Forbrugeraftaleloven). See our Returns Policy for the full procedure.
6. Conformity and statutory remedies
Products must conform to the description. You have at least the 2-year statutory complaint right (reklamationsret) under Danish law for defects. Contact us at support@modestly.dk to make a claim.
7. Intellectual property
All content on the platform — including text, images, brand assets, and product photography — is owned by Modestly or its partner brands and licensors and may not be reused without permission.
8. Acceptable use
You agree not to:
- Use the platform for any illegal or fraudulent purpose.
- Interfere with the platform, scrape product data, or attempt to access another user’s account.
- Submit content that is unlawful, harassing, or infringes anyone else’s rights.
9. Liability
To the extent permitted by Danish law, Modestly’s liability is limited to the value of the order in question. We are not liable for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded under mandatory consumer law.
10. Disputes and governing law
These Terms are governed by Danish law. Disputes will be heard by the competent Danish courts. You may also submit a complaint to the Danish Center for Klageløsning (forbrug.dk) or, for cross-border disputes, the EU’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Changes
We may update these Terms from time to time. We will post the new version with the “Last updated” date above. Material changes will be communicated by email to registered users.
